BRIAN TANNEBAUM QUOTED IN THE DBR– ‘THE ART IS SLOWLY FADING’: ARE LITIGATORS BEING PENALIZED FOR PASSION?

February 24th, 2023 - Posted in Brian L. Tannebaum, In The News

MIAMI, FL– February 24, 2023- Bast Amron Special Counsel Brian Tannebaum was quoted in a recent article by The Daily Business Review, ‘’The Art Is Slowly Fading’: Are Litigators Being Penalized for Passion?” Brian talks to the DBR about the ‘The Downfall of the Lawyer’ and how today’s lawyers must also grapple with new potential pitfalls.

In seminars, Tannebaum teaches, “So you know, the basic concepts: Hit ‘save’ before ‘send?’ That’s something I always tell lawyers. … when you’re writing that nasty email, hit ‘save,’ not ‘send.’ Review it for 24 hours. I guarantee when you look at it, 24 hours later, you’re gonna have a different thought about it.”

Tannebaum also discouraged lawyers from letting their passions impede their judgment. He said they need to remember they could never win a war against the judge.

“Lawyers need to understand that courtrooms are run by judges who determine how the courtroom is going to run. You should be a zealous advocate for your client, and you should do whatever you can ethically and legally to represent your client on either side,” he said. “But in the end, a judge’s order is a judge’s order”.

Tannebaum added, “Lawyers have to control their emotional reaction to decisions that are made because to me, getting emotionally involved in these issues, is the downfall of the lawyer.”

Tannebaum’s tongue-in-cheek conclusion, “I think the advent of technology is the best and worst thing that’s ever happened because, a) it allows us to communicate immediately, and b), it allows us to communicate immediately.” The Downfall of the Lawyer’.
