MIAMI, FL– August 4, 2023- Bast Amron, as counsel for Buchwald Capital Advisors as Liquidating Trustee of Orchids Paper Products Liquidating Trust, filed a complaint against the Office of the U.S. Trustee seeking a refund of over $450,000 in quarterly fees charged under an unconstitutional amendment to the quarterly U.S. Trustee fee schedule. Bast Amron, counsel to the Trust, previously represented the liquidating trustee in a successful challenge to the constitutionality of that amendment, which was litigated up to the Supreme Court. Most recently, Bast Amron prevailed before the Eleventh Circuit Court of Appeals on the entitlement to a refund of the excess fees.

This is a high-profile issue that will be closely monitored by industry professionals.

The proceeding is Buchwald Capital Advisors LLC v. Vara, et al., Adv. Proc. No. 23-50450-MFW (Bankr. D. Del.).
